Orubebe appeals CCT judgment on property

Mr Godsday Orubebe, ex-minister of Niger Delta, on Wednesday approached the Court of Appeal Abuja to set aside judgment of the Code of Conduct Tribunal that convicted him for non-declaration of an asset. The notice of appeal filed on Oct.12, was made available to newsmen by lead counsel to the appellant, Mr Selekeowei Larry (SAN).

Mr Danladi Umar, Chairman of the tribunal, delivering the judgment on Oct. 4, ordered the forfeiture of the asset, a plot of land located in Asokoro part of the FCT to the Federal Government. Umar also held that the appellant surreptitiously hid the asset from the Code of Conduct Bureau (CCB) for selfish reasons.

He held that the claim of the appellant that he (Orubebe) divested the property to a third party was an act to cover up the criminal act. But counsel to the appellant said the tribunal erred in law when it held that the appellant was found guilty as charged.

He said the tribunal equally erred in law when it on the above premise ordered the forfeiture of Plot 2057 at Asokoro District, which did not belong to the appellant.

The appeal said the property was neither acquired corruptly nor purchased by the appellant, adding that it was a gift from the respondent (Federal Government).

The notice of appeal said the tribunal further erred when it held the appellant remained the owner of the property despite evidence of transfer to a third party.

"The learned trial tribunal erred in law when it held that the appellant remains the owner of Plot 2057, Asorko District, when evidence clearly shows various deeds of transfer.

"Not only were the deed of assignment, deed of sale and power of attorney tendered and admitted in evidence, the two defence witnesses testified to the transaction without contradiction.

"There is no time limit for regularisation of title at the Lands Registry,'' it said.

The notice of appeal also said: "Under the law, the first defence witness (Divention Properties Ltd) is the holder of equitable interest in the said plot having paid for it.

"The finding of the tribunal is perverse and should be vacated in the interest of justice,'' it said.

Advancing argument, the appellant counsel said "the judgment does not in any way contemplate our law''.

"Our law does not ascribe ownership of a plot of land as in this case to the person who had divested his interest by selling to another.

"Orubebe had divested his interest in the said Plot 2057 Asokoro District, an empty land in the bush when he sold it to Mr Akinwumi Ajibola who claimed same in his evidence.

"In fact, the appellant made it very clear to the tribunal that the transaction was well made before his last declaration of assets held to be in breach of the law,'' Larry said.

Larry also said: "Let us even assume without conceding that Orubebe did not declare the property, it would still not amount to infraction because the Plot 2057 was a gift by the respondent.''

"In one sentence, the judgment of the tribunal was simply a travesty of justice,'' he added.

Orubebe was a minister under the administration of former President Goodluck Jonathan and became popular when he tried to disrupt the collation of the 2015 presidential election results.

NiMet predicts cloudy, rainy weather for Thursday

The Nigerian Meteorological Agency (NiMet) has predicted cloudy weather conditions over the central states with prospects of early morning isolated thunderstorms over Abuja, Jalingo, Bauchi, Makurdi and Mambilla on Wednesday morning.

NiMet gave the predictions in its Weather Outlook issued by the Central Forecast Office (CFO) on Wednesday in Abuja.

It added that localised thunderstorms would prevail over the high ground areas of Lokoja, Minna, Jos and Bida during the evening/night hour with maximum temperatures of 28 to 32 degrees Celsius.

The agency also predicted that the southern states would experience increased cloudiness in the morning with probability of localised rains over the coastal cities of Lagos, Port Harcourt and Calabar.

It predicted that localised thunderstorms and rain showers would prevail over the region during afternoon and evening hours with maximum temperatures of 29 to 31 degrees Celsius.

NiMet predicted morning partly cloudy to cloudy conditions over the northern states with localised thunderstorms over Sokoto, Yelwa, Kano and Kaduna in the evening and maximum temperatures of 32 to 37 degrees Celsius.

3 killed, 2 policemen injured in Police/Shi'ites' clash in Funtua

The Police in Katsina State said at least three persons died during a clash between policemen and members of the Islamic Movement in Nigeria (IMN), also known as Shi'ites, in Funtua Local Government Area of the state.

The Commissioner of Police in the state, Alhaji Usman Abdullahi, stated this during a news briefing on Wednesday in Funtua.

Abdullahi said that two policemen were also injured during the clash.

According to him, the police have arrested 46 persons comprising men and women for participating in the unlawful procession.

He said the incident occurred when members of the Shi'ites group attempted to burn the Police Area Commander's office in the town during the procession.

The commissioner also said that members of the group opened fire on policemen using Dane guns, which he said, compelled the police to retaliate, killing three persons.

According to him, one of the sect members killed wore a mobile police uniform.

The commissioner said that the police recovered five Dane guns, sticks, cutlasses, among other locally made weapons from members of the group.

He said that the police had intensified surveillance and patrol in the area to ensure safety of lives and property.

Abdullahi called on the people of the area to go about their lawful businesses as the situation had been brought under control.

Commercial and other activities were brought to a halt in the town, particularly on the roads leading to the Funtua Central Mosque, during the incident.

Police averts bloodbath in Kano as hoodlums attack Shi'a group

KANO – The police in Kano Wednesday averted bloodbath following attack on members of Islamic movement of Nigeria popularly known as Shi’a by hoodlums as no fewer than 17 were injured.

The incident that occurred sporadically at various spots at the central areas of the city saw defenceless members of Shi’a group scampered for safety in the face of machete welding hoodlums.

Eyewitness told Vanguard that at about 1.10pm hundred of members of the Shi’a group were seen heading to Bayero mosque at Fagg, when mob attack the procession at Koki by Kofar Mazugal general areas.
Another violent clash was recorded at Fagge mosque as residence protested closure of market and several routes in the area and chased them off.

Igbonla kidnap: Lagos restates commitment to rid state of criminal elements

The Lagos State Government on Wednesday confirmed the release of the four pupils and teachers of the Lagos State Model College (Senior and Junior) Igbonla in Epe who were kidnapped by suspected ex-Ijaw militants on October 6, 2016, assuring that the Government would spare nothing until it rids the State of criminal elements.

The Government, in a statement signed by the Commissioner for Information and Strategy, Mr. Steve Ayorinde, said the children have undergone medical check-up after which they were reunited with their families.

"The Lagos State Government today welcomed the release of the school pupils, Vice-Principal and Head teacher of Igbonla Model College, Epe, who were kidnapped by suspected Ijaw militants on Thursday October 6, 2016.

"The children are doing well; they have been taken through medical checkup and have been safely reunited with their families."

Ayorinde, while restating the government's determination to protect lives and property, however urged residents to be more vigilant, security conscious and report all suspected persons and objects seen within their neighbourhood to the appropriate security agencies.

"The determination of the government to ensure 24-hour security of the State is evident in the huge investment in the equipment and welfare of security agencies, especially the police".

The Commissioner, however, said that Government has taken adequate steps to stem the tide of kidnapping in the State, noting that in line with the directive of the State Governor, Mr. Akinwunmi Ambode, plans have been concluded to commence the demolition of illegal structures erected across the state waterfronts and creeks.

"Often times, the incidence of kidnapping are perpetrated through the waterways and as such, these illegal structures provide a leeway for these criminal elements to plan and execute their nefarious activities. This step, we believe, will go a long way to address this menace.

"The State Government has also begun steps to boost community policing with the recent announcement by the Governor that at least 5000 neighbourhood watchers will soon be recruited to improve surveillance across the state, especially at the rural areas," Ayorinde said.

May rejects call for vote as parliament debates scrutiny of Brexit

London – Theresa May, British Prime Minister, has promised to allow "proper scrutiny" of Britain's Brexit negotiations, but rejected calls for a vote, as parliament debated its role in overseeing the government's strategy.

May on Wednesday in London declined to say if leaving the EU single market was a "red line" in her Brexit negotiations.

She told the parliament that she aimed to retain "maximum possible access" to the single market but control the movement of EU citizens into Britain.

May stressed that she is rejecting the idea that leaving the single market means a "hard" Brexit that could be more damaging to Britain's economy.

"We are listening to the British people and delivering on that referendum result.

May also declined to give details of her position to the parliament, insisting that she would not provide a "running commentary" on the negotiations.

Meanwhile, Tim Farron, the opposition Liberal Democrat leader said that May had already "chosen a 'hard Brexit' that was never on anybody's ballot paper" in the referendum.

Labour leader, Jeremy Corbyn, also said: "This is a government that drew up no plans and no strategy for negotiating Brexit.

He stressed that as at now it has offered no clarity, transparency, and no chance of scrutiny of the process for developing a strategy.

Corbyn, said that Labour, the largest opposition party, has tabled a motion calling for May to allow parliament to scrutinize her Brexit plan before she triggers Article 50 of the Lisbon Treaty, which sets the rules for a two-year negotiating process for a nation leaving the EU.

El-Rufai abandons school feeding "for now"

KADUNA – Governor Nasir el Rufai of Kaduna State, Wednesday said the state would no longer continue its controversial School Feeding Programme, (FBS) which was costing the state N1.1 billion to serve 1.8 million pupil one meal in seven months.

The Governor said that since the state was yet to get reimbursement from the Office of the Vice President, it the programme stood suspended until that was done.

In another surprising pronouncement, the governor said it would no longer rehabilitate the thousands of dilapidated Schools and their classrooms across the state, saying he would instead erect brand new schools in their place from 2017 to 2019.

The Governor made these revelations during his budget presentation at Kaduna State House of Assembly, Kaduna.

FEC approves N700m for completion of federal secretariats in Anambra, Bayelsa, Gombe, others

ABUJA-Federal Executive Council, FEC, Wenesday approved the sum of N700 million for the completion of federal secretariats in Anambra, Bayelsa, Gombe, Nasarawa, Osun and Zamfara states.

The council also gave approval for the completion of the abandoned Katsina 10 megawatts Wind Farm power project in Katsina state.

This was even as the establishment of an outline Business case for Industrial Port Development in Badagry, Lagos State also received the nod of the council.

Minister of Power, Works and Housing, Babatunde Fashola and his counterpart in the Ministry of Transport, Minister of State for Aviation, Hadi Sirika gave the revelation while briefing State House Correspondents on the outcome of the FEC meeting at the presidential villa, Abuja on Wednesday.

Fashola said that funds for the completion of the respective secretariats which he said were abandoned since 2012, were made in the 2016 budget.

He said “The second memo has to do with the ongoing projects for the construction of Federal Secretariats to accommodate officers of the federal government posted to states in order to render service to them.

“Again, this is another ongoing projects which had stalled since 2012 or there about. They are in Anambra, Bayelsa, Gombe, Nasarawa, Osun and Zamfara states.

“They are at various stages of completion. There have been changes in cost as a result of project designs, amendment, cases where original location and contract are changed and they have to be redesigned in such structure”.

On the Wind Farm power project in Katsina, the minister said that the project was part of government's strategic plan for renewable energy.

Also speaking, Minister of State for Aviation, Sirika, said council also approved the relocation of simulator from Lagos to Nigerian College of Aviation Technology (NCAT), Zaria in Kaduna state for training of pilots and engineers.

Pop superstar Janet Jackson has confirmed that she is pregnant with her first child at age 50 — and has the baby bump to prove it.

People magazine on Wednesday published a portrait of the star, her face beaming as she stood on a beach, with an unmistakably protruding belly.

“We thank God for our blessing,” she told the magazine.

The younger sister of late king of pop Michael Jackson in April stunned fans by halting a global tour and saying that she and her husband, Qatari tycoon Wissam Al Mana, were “planning our family.”

Jackson had not said more since then but was recently spotted by paparazzi shopping at a baby store in London — and looking like she had the tell-tale bump.

Dalung urges military to use its retired athletes in service games

Abuja – The Minister of Youths and Sports, Solomon Dalung, has urged the military to help improve the quality of sports by tapping from the experience and knowledge of its retired athletes.

Dalung, in a statement on Wednesday in Abuja signed by the ministry's Director of Press, Tolu Makinde, said the military has a lot to tap from those retired athletes' competencies.

The statement quoted the Minister as saying this while receiving a 12-man delegation of officers of the Nigerian Air Force, led by Air Commodore Charles Oghowen, during a visit.

"Organisers of sports competitions in the military should use the retired icons in their games as coaches, referees, judges and umpires to improve the standard of their games,'' it quoted Dalung as saying.

The Air Force delegation visited Dalung to inform him of the 2016 Nigeria Air Force Games scheduled for Katsina.

The Games, which will feature 13 sports, is to hold from Oct. 24 to Oct. 29.

Dalung described the Nigerian Air Force and the Ministry of Youths and Sports as partners in progress on issues of sports.

He appreciated the significant role being played by the Air Force in safeguarding and protecting the country's territorial integrity and ensuring its air space remained secured.

Dalung commended the Air Force for organising sports not only to keep its men and women in healthy shape but as instrument for promoting peace and unity and strengthening the nation.

He promised that the Ministry would help nurture sports talents discovered at the Games to the highest level to represent the country in future international competitions.

Earlier, Oghowen who is Chairman of the Nigeria Air Force Games 2016 had solicited the Minister's support for the Games to be a successful event.

Nigerian women entrepreneurs, especially startups, however, do not have this support network and end up drowning in the face of even the most trivial obstacles.

In fact, a number of female founders report that lack of available advisers and mentors has been a huge limitation to their professional growth. While there are a few expert organizations and groups like WIMBIZ e.t.c , more institutions need to be set up and women-focused networking events held to encourage the women so as to spur growth in their businesses as well.

Societal discrimination
This is a huge issue that has specifically affected the presence of women in the Nigerian tech scene. In Nigeria, a majority of people still like to think that certain businesses or tasks are better handled by men than women. You rarely see women driving a commercial bus, working as a mechanic or running a tech startup as the society often assume women are generally incompetent in certain fields of work.

Women now think twice before owning or delving into certain businesses because of the stigma that could come with it. And while you think this challenge may be uncommon, it actually has played a strong role in hampering the proliferation of women-owned businesses.

Ozone Layer Protection: FG kicks-off review of draft policy document

ABUJA – The Federal Government has began the review of the Draft Reviewed National Environmental (Ozone Layer Protection) Regulations 2009 as part of efforts towards the universal protection of the Ozone layer in Nigeria.

Ozone layer is a protective blanket in stratosphere that protects us from harmful radiation from the Sun particularly the Ultraviolet (UV) rays which are electromagnetic radiations.

The Director General, National Environmental Standards and Regulations Enforcement Agency (NESREA), Dr. Lawrence Anukam said the need for safe disposal of Ozone Depleting Substance (ODS) in Nigeria is crucial, considering the severe environmental and health problems associated with them.

Anukam, who stated this at the Workshop on "Expert Critique Meeting on Draft Review National Environmental (Ozone layer protection) Regulations 2009 for the Federal Republic of Nigeria" in Abuja,, the idea of undertaking the program and its significance to Nigerian economy cannot be over emphasised.

He said, "This administration is fully committed to the ideas of good governance and the goal of environmental sustainability aimed at providing the people with a healthy environment upon which the natural ecology of the country can develop and be sustained.

"Globally, the adverse effects of the ODS have increasingly become an important issue. This is as a result of the several pollutants which attack the ozone layer creating a hole, chief among them is the class of chemicals (ODS) known as Chlorofluorocarbons (CFCs), used as refrigerants (notably in air conditioners), as agents in several manufacturing processes, and as propellants in spray cans. These substances are thus controlled under the Montreal Protocol on Substances that deplete the Ozone Layer."

Speaking to journalists at the workshop, the UNIDO Country Representative and Regional Director for ECOWAS, Dr. Chuma Ezedimma said man's quest for industrialization has seen the development and production of chemicals that depletes the Ozone Layers.

"Mans quest for industrialization has seen the development and production of chemicals that depletes the ozone layers and exposure to UV rays as a result of the ozone layer depletion can cause severe harmful effects to man and the environment.

"Nations are evolving with measures to protect their environment, it is therefore important and mandatory for Nigeria to reflect in its laws, disposal of ODS waste and it is also important for the country to begin the adoption and implementation of the extended producer responsibility initiative which ensures that manufactures are responsible for the entire life circle of their products.

"This should also apply to refrigeration, air conditioners and installation products and this will contribute immensely to materials and energy conservation and eventually the sustainability of the environment," he stated.

The Beat of Lagos concert debuted in 2011, provides an atmosphere for networking and also serves as a timeout to celebrate entertainment icons and songs that has kept us dancing the year round. The concert accommodates a minimum of 3,000 physical crowds yearly. "Beat of Lagos Award" was introduced at the 2014 edition and endorsed by the Lagos state Government while the Mavin crew won the award for their song Dorobucci. The 2015 award went a notch higher by rewarding the winner Adekunle Gold for the hit song Sade with a plot of land at the Lekki.

The previous editions had performances from top artistes like,  PSquare, Tuface, M.I , Jesse Jags, Wande coal, Skales, Davido, Tiwa Savage, Burna boy, Dr Sid, hidinma, Wizkid, Olamide, Phyno, Iyanya, Dammy Krane, Yemi Alade, Lynnx among others.

Return my late mother's necklace before you divorce me, man tells wife

"My wife must return my late mother's gold necklace before she can divorce me,'' a 40-year-old civil servant, Mr Olufemi Ojikutu, has told an Igando Customary Court in Lagos.

He told the court on Wednesday while responding to a suit filed by his wife, Olaide, that if she insisted on divorcing him, she must return his gold because it was his inheritance.

Ojikutu said that his mother gave him and his siblings a gold necklace each to give to their wives when they marry with a condition that the wife must stay with them for life.

"When my mother was about to die, she called me and my three brothers, gave us a gold necklace each, telling us to give it to our wives that will be with us for better for worse till death do us apart.

"She told us the value of each gold- mine was 21 carats valued at N125,000 as at 1995 when she died.

"She promised not to forgive anyone who violated her order,'' he said.

The respondent said that he had kept the gold for about 20 years before his wife came to borrow it in 2014 and refused to give him back.

"My wife borrowed my gold necklace but has not returned it; now that she wants to divorce me, she must return the gold necklace, it is not negotiable," Ojikutu said.

He expressed the belief that his wife must have sold the jewellery as she used to sell his clothes.

Ojikutu urged the court to grant his wife's wish for dissolution of the marriage, saying he too was no longer in love and only wanted the return of his gold necklace.

The 28-year-old petitioner, who had approached the court to terminate her five-year-old marriage over infidelity, agreed that she collected the gold necklace from her husband.

"'I collected the gold from my husband when I wanted to go for an event but I can't just remember where I kept it,'' Olaide, a clothes trader, told the court.

The mother of two accused her husband of infidelity.

"My husband is having an affair; I once stumbled on some pictures on his whatsapp messages where he and his lover were sending their naked pictures to each other," she said.

She described her husband as an irresponsible husband and father.
"My husband does not care for me or the children; even during festive periods, he never buys the children clothes or shoes.

" My mother was the one taking care of our children. Whenever I ask him for money, he is always annoyed and often begins keeping malice with me for weeks," she said.

According to her, she left her matrimonial home on Feb. 7, 2015 after her husband changed the key of the house and locked her out.

She begged the court to terminate the five-year-old marriage, saying that she was no longer in love.

The president of the court, Mr Adegboyega Omilola, said that the case would be left on sine die stage until the petitioner returns the respondent's gold necklace.

"Since the respondent insisted on collecting back his gold necklace, the judgment will not be read just for peace to reign until the gold necklace is produced.

" The case will be on sine-die stage," Omilola ruled.

Am hale, only sustained head injury from broken bathroom tile - Gov. Okowa

The Delta state Governor, Mr. Ifeanyi Okowa has though, confirmed that he sustained injuries on his head from a broken bathroom tile at the government house, refuted claims that he was ever flown abroad for treatments.

Recall that rumours had circulated that the governor had slumped at the government house during the Independence Day celebration and was later flown abroad for treatment, preventing him from officiating the independence celebration as well as performing other government functions afterwards.

However, Okowa, during a church service at the Government House Chapel on Wednesday, dismissed the report that he was flown abroad for medical treatment after the incident

“The truth is that last Wednesday, I entered the bathroom in my office and one of the tiles fell off from the wall, and I had a minor cut on my head and I had two stitches, and it was treated, and I was ok. People know I am a workaholic, and that Is why it didn’t stop me from working, I am hale and healthy."

“Am told that certain section of the social media reported that I have been flown abroad for medical treatment. When and how did that happen? It is unfair and uncharitable to disseminate false information. It is very unfortunate at this age and time that people will intentionally misinform others when there are opportunities to find out what might have happened,” Okowa lamented.

Okowa, however, appealed to the media to imbibe the culture and tenets of the noble profession through a thorough investigation of issues before publishing.

Upgraded Era Solutions to host cyber- security challenge

One of Nigeria's fast growing IT and cyber security firms, Upgraded Era Solutions Limited, is hosting a cyber security challenge event (CYSEC NG), the first of its kind in Nigeria.

There would be a hacking challenge where participants will compete and a winner will emerge and awarded the Ultimate CYSECA 2016 and a cash prize and other consolation prizes for runners-up.

Speaking on the summit, Senior Vice President of Centre for Strategic Cyberspace + Security Science (CSCSS), Mr. Kelechi Agbugba, said: "The initiative will help get our youths skilled up in cyber security as well as provide direction towards building a viable IT/ cyber security professional base for Nigeria".

The Managing Director of Upgraded Era Solutions Limited, Mr. Victor Idonor, also speaking on the event, said: "It is a conference aimed at identifying Nigeria's next generation of cyber security professionals, connecting Nigeria's best and brightest to the cyber security industry, and bringing together all stakeholders in the I.T security industry to deliberate on the most logical way to address the forever growing cybercrime wave recorded within and outside Nigeria.

In so doing, we will ascertain the overall implication to the nation's economy and political stability as well as the global image of the Nigeria in the comity of nations battling cybercrime."

Human rights groups protest in Lagos, demand resignation of arrested judges

MEMBERS of the Human rights and anti-corruption groups, held a peaceful protest yesterday in Lagos urging the judges arrested last weekend by the Department of State Security ,DSS, to resign from their respective positions ahead of their prosecution.

The groups, which were led by Comrades Desmond Abiola and Kola Salau, grounded vehicular activities in Alausa during the peaceful procession.

The placard-carrying groups unanimously said the DSS acted within its jurisdiction by arresting the judges, adding that the judiciary must be sanitized as the only hope of common man.

Salau, who made the group's position known, said it was hypocritical for some people to have described what the DSS did as a clampdown on the judiciary.

He said: ''There must be no place for corrupt judges in this country. We need a sanitized judiciary to achieve success in the anti-corruption and anti-terror war. We need a clean bench to drive democratic reforms.

“All the judges so far indicted or arrested for corruption should immediately resign considering the magnitude of the case that the DSS has built against them.

The cases of those that have been given lenient punishments by the National Judicial Council (NJC) should be revisited with a view to dragging them before a law court. The DSS must widen its investigation to take in all the petitions that the NJC had earlier discarded.''
